•••• T-Mobile, with 33.4 million mobile customers, is the nation's fourth-largest cellphone company; MetroPCS is the fifth with 8.9 million customers.
••••The combined company will still be in the No. 4 position behind Verizon, AT&T and Sprint.
••••Under the terms of the agreement, MetroPCS shareholders will receive $1.5 billion in cash and 26% ownership in the company, which will have the T-Mobile name. Deutsche Telekom AG, the Germany company that owns Bellevue, Wash.-based T-Mobile, will receive a 74% stake. MetroPCS is based in Dallas.

108-AT&T$14BillionUpgrade
The Webusers Guild.com (WUG) reported that AT&T said it will invest $14 billion improving and expanding its wireless and broadband infrastructure, over the next three years.

•••• The Texas-based company said $8 billion will be used to improve its wireless network. According to AT&T it plans to expand its 4G LTE high-speed Internet wireless network to cover 300 million people by the end of 2014.
•••• That means an improvement over the company's current plan, which would expand the network to cover 250 million people by the end of next year.
•••• The latest plan, which AT&T calls Project Velocity IP, dedicates the remaining $6 billion to improving the company's fiber-optic, broadband networks.
•••• AT&T will expand its high-speed U-Verse TV, Internet and VOIP service to 8.5 million more customer locations by the end of 2015. AT&T said the investment will boost U-Verse speeds to 75 Mbps, or about three times faster than the fastest service currently offered.
•••• Julius Genachowski, the chairman of the Federal Communications Commission, called AT&T's investment plans proof that there is a positive climate for investment and innovation in the country's communications sector. 
•••• "Extending wired and wireless broadband across America is the 'great infrastructure challenge of the 21st century,'" he said in a statement. "America's 21st century economy and our global leadership depend on meeting this challenge."

WASHINGTON, D.C. - Federal Communications Commission Chairman Julius Genachowski will participate in question-and-answer session at the 2013 National Association of Broadcasters (NAB) Show in Las Vegas,. Genachowski will sit down for a conversation with NAB Joint Board Chair Paul Karpowicz, president of Meredith Corporation - Local Media Group, on Wednesday, April 10 at 9 a.m. in Las Vegas.
•••• "NAB looks forward to hosting Chairman Genachowski at the NAB Show once again to hear his views on current and future communications issues before the Commission," said NAB President and CEO Gordon Smith. "This session is sure to be informative for radio and TV broadcasters and an excellent opportunity to learn about the regulatory issues shaping our industry."
•••• Genachowski was sworn in as FCC chairman in June 2009 after spending more than ten years in the private sector as an executive and entrepreneur in the technology industry. Forbes's 2013 list of the world's richest people includes a record number of 1,426 billionaires, with a total net worth of $5.4 trillion, up from $4.6 trillion in the previous ranking.

There are 210 new billionaires from 42 countries, including 27 from the United States. The average net worth of those on full list has risen to $3.8 billion from $3.7 billion. Sixty people have dropped off the list and eight have died.
••••Mexico's Carlos Slim, who has taken a hit from the slump in the share price of his America Movil telecoms group since the list was calculated as of Feb. 14, remained the richest person with a fortune of $73 billion, and Microsoft co-founder Bill Gates held on to the No. 2 spot with a net worth of $67 billion.
••••Spain's Amancio Ortega, the co-founder of the Inditex fashion group, leapt over Warren Buffett and France's Bernard Arnault to become the world's third richest person on Forbes' 2013 annual ranking of billionaires, with an estimated net worth of $57 billion.
••••Ortega's fortune increased $19.5 billion, the biggest gain for any of the billionaires, from the report in 2012. He jumped two places and bumped Buffett, chairman and chief executive of conglomerate Berkshire Hathaway Inc with a fortune of $53.5 billion, out of the top three to the No. 4 spot for the first time since 2000.

•••• "There will be more Asian billionaires than American billionaires by the end of this decade, actually by the middle of this decade," said Lane. "That is a statement about where global growth is."
•••• Americans captured five of the top 10 spots including brothers Charles and David Koch, owners of Koch Industries Inc, who tied for sixth place with $34 billion each.
•••• France's Liliane Bettencourt, of the L'Oreal cosmetics empire, is the world's richest woman, coming in ninth with a $30 billion fortune.

Mexico's Carlos Slim of America Movil telecoms group, remained the richest person on Forbes' 2013 annual ranking of billionaires with a fortune of $73 billion.

One of the biggest U.S. prepaid company, with just over 21 million customers, is TracFone Wireless Inc. The company is a subsidiary of Mexico's America Movil, owned by Mexican mega-billionaire Carlos Slim, who is leveraging his long experience in Latin America north of the border.
•••• Low-cost prepaid phone service has become one of the hottest performers in the U.S. wireless market. The move toward prepaid cellphone service in the United States is starting to mimic a pattern that has long been the rule in the developing world. Prepaid accounts for 95% of cellphone handsets in India, 80% in Latin America, 70% in China and 65% in Europe, according to Chetan Sharma, a Washington state wireless consultant.
•••• Growth is spurring a wave of international mergers. TracFone Wireless Inc. is acquiring Simple Mobile of Irvine, while Deutsche Telekom's T-Mobile plans to merge with MetroPCS. Japan's Softbank Corp. is buying a 70% stake in Sprint.
•••• Many companies have begun to offer upscale handsets using 4G networks which has helped prepaid shed its reputation for low-cost, hard-to-track phones favored by drug dealers on TV crime shows. So-called burner phones are hard to trace because their SIM cards -- memory chips that activate the handset -- can be store purchased for cash, and the new owner doesn't need to sign and be bogged down with lengthy contracts, phone charges they couldn't predict, or get a credit check.
•••• Prepaid has moved quickly into the smarter phones with more sophisticated users and is really challenging the market.
•••• The monthly cost of a prepaid phone plan can run as low as $20 every three months for bare-bones with 60 minutes of voice service, with a $10 handset offered by TracFone. Per-minute costs drop with added usage, and unused minutes can be banked for future local or long-distance calls.
•••• TracFone doesn't have its own network of cell towers and electronic spectrum. Instead, it buys excess capacity from the big four cell companies. "People can get the same phone networks for less than half the price," saidTracFone's chief executive and founder, F.J. Pollak.

The binational activist organization Two Countries, One Voice is calling for more California State regulation.
•••• TracFone Wireless Inc. a prepaid cellular company controlled by Mexican billionaire Carlos Slim is taking fire as it moves to expand in the lucrative California market. Regulators say TracFone should pay the state the same fees that other telecom firms do.
•••• The Miami company is being bashed publicly by activists on both sides of the U.S.-Mexican border because of what they call monopolistic business practices of its corporate parent, Mexico City-based America Movil. Slim, the company's chairman, is worth an estimated $73 billion and tops Forbes magazine's most recent 2013 list of the super wealthy.
•••• California regulators have been investigating TracFone for more than three years. In early 2012 the state Public Utilities Commission ruled that the company violated California law by refusing to send the state required service fees that it should have been collecting from customers.
•••• Officials at the Public Utilities Commission contend that TracFone could owe them as much as $20 million. The company is appealing the ruling to the state Court of Appeal.
•••• Los Angeles County lawmakers say they expect to introduce a bill that would give the state more authority to regulate prepaid cellphone companies such as TracFone and approve proposed mergers in the future.
•••• TracFone executive VP and general counsel Rick Salzman said, "Our whole program is to save people money," "We generally provide a comparable service to our competitors at a lower cost, and it's less burdensome on the customer as well, with no early termination fees, no contracts and no long-term commitments."
•••• He criticized the commission's ongoing efforts to make TracFone collect the so-called universal service fees that traditional wireless and land-line carriers bill customers and remit to the state to fund programs for the deaf and disabled, the poor and rural residents.
•••• Most phone companies add the fees, which are small percentages of the total bill, on monthly statements. But prepaid services "have no legal or practical way to collect the fees" since the minutes are bought at stores before the calls are made, Salzman said.
•••• In a lengthy legal proceeding the Public Utilities Commission rejected TracFone's arguments that it merely resells cellphone minutes purchased from other companies.
•••• "TracFone is ultimately responsible for payment of these user fees," the five commissioners unanimously decided.
•••• The amount of back fees that TracFone could ultimately pay will be decided in the second phase of the proceeding. in 2013.
•••• In the meantime, Salzman said, his firm is remitting the fees under protest.
•••• TracFone's attitude toward regulators underscores the need to bolster the Public Utilities Commission's authority to approve or reject a prepaid cellphone merger, especially when the company has been fighting efforts to require it to collect legally required state fees.

Film producers who are looking for exciting literary material for the screen should be in their element at "Books at Berlinale" on February 12, 2013. Ten novels that might make good movies will be presented at this year's "Books at Berlinale" within the scope of the Berlinale Co-Production Market.
••••Organised since 2006 by the Berlinale in cooperation with the Frankfurt Book Fair, "Books at Berlinale" was and is the first market for literary material at an international A-film festival.

101- Les Moonves, Bob Schieffer Named to TV Hall of Fame
"Face the Nation" anchor Bob Schieffer and CBS Corporation President and CEO Leslie Moonves were selected to be inducted into the Academy of Television Arts & Sciences Hall of Fame. The 2013 inductees will be honored during a gala ceremony at the Beverly Hilton Hotel on March 11.
•••• "Each of this year's Hall of Fame inductees is incredibly deserving of this honor and is truly a legend of our industry," said Bruce Rosenblum, Chairman and CEO of the Academy of Television Arts & Sciences.
•••• Past honorees include actor/director/producer Ron Howard, sportscaster Al Michaels and writer/producer Dick Wolf. Philo T. Farnsworth, who is credited with inventing all-electronic television transmission, will be inducted posthumously, the academy said.

 101- National Film Registry Adds New Films "A Christmas Story" - Uncle Tom's Cabin"
••••Under the terms of the National Film Preservation Act, each year the Librarian of Congress names 25 films to the National Film Registry that are "culturally, historically or aesthetically" significant. The films must be at least 10 years old.  The Librarian makes the annual selections to the registry after reviewing hundreds of titles nominated by the public and conferring with Library film curators and the distinguished members of the National Film Preservation Board (NFPB).  The public is urged to make nominations for 2013 registry at the NFPB's website (www. loc.gov/film).

••• During the last two decades of Troy Cory's China concert tours, Ambros Seelos delivered the big-band background sound for many of Troy's TV-stage performances, "Jeepers Creepers" being a favorite amongst the Chinese audiences.

•••It was in 1977, that TV star Cliff Robertson's Show Biz Career took an unexpected twist. It was right after he received an IRS form for "miscellaneous income" that indicated that Columbia Pictures had paid him $10,000 the previous year. Robertson, however, hadn't done any work for Columbia that year and had not received $10,000 from the studio.
••• After asking his accountant to look into it, Robertson learned that a check for $10,000 had been made out to him and had been cashed at a bank in Beverly Hills. The endorsed check, bearing Robertson's forged signature, had been processed and paid out in American Express travelers' checks to the president of Columbia Studios, David Begelman.

In a threat to the 4th Amendment, law enforcement is using location data as a crime-fighting tool.
Concern over mobile phone networks becoming surveillance tools, the American Civil Liberties Union recently asked hundreds of local law enforcement agencies whether they've tracked people's movements through their cellphones. Most of those that responded said they had, usually obtaining the information from mobile phone companies without a warrant. The practice has become so routine, the ACLU found, that phone companies are sending out catalogs of monitoring services with detailed price lists to police agencies. The alarming findings should persuade Congress to clarify that the government can't follow someone electronically without showing probable cause and obtaining a warrants.
••• The Supreme Court has long held that the 4th Amendment guarantee against unreasonable searches and seizures requires police to obtain a warrant if the intrusion would violate a target's "reasonable expectation of privacy."
Mobile phone networks collect another -
type of data that wire-line networks don't: They register a phone's location continuously as long as it's turned on, even when it's not in use. Those records can be exceptionally revealing; as the ACLU put it, the potential insights range "from which friends you're seeing to where you go to the doctor to how often you go to church."
The fact that phone companies are collecting fees --
for providing this information raises the additional question of whether their financial interests trump their customers' privacy interests. Looking for an answer, Rep. Edward J. Markey recently asked the major wireless carriers how much money they've collected from law enforcement agencies and whether they actively market their information-gathering services.

••• The federal copyright law that went into effect in 1978 gave song writers, recording artist, and musician union members a chance to reclaim their rights to a work 35 years after they sold them. Whether musicians and songwriters can exercise that option, however, is in dispute. Many bands and solo acts have signed contracts since then that declare them ineligible to reclaim their recordings.
••• Most songwriters signed long-term contracts with music publishers before 1978 that their publishers say are controlled by the previous federal law, which prevents copyrights from being reclaimed for 56 years. The Copyright Office has tried to resolve the latter dispute, but it acknowledged that the final say may have to come from Congress.
••• The new U.S.A. Copyright law gives the author of an original work a lot of control over how their creations can be exploited. 106-TVCopyrightLawTargeted"Bad" -- An arcane but critical copyright law is under attack by a key government agency.
•- The U.S. Copyright Office, which advises Congress on copyright issues, is proposing that lawmakers phase out the cable and satellite statutory licenses in the Copyright Act, calling it "an artifact of an earlier era."
•- The so-called compulsory license, established in 1976, allows cable and satellite operators to distribute broadcast television signals in return for paying a one-size-fits-all copyright fee to the Copyright Royalty Tribunal (CRT). The CRT then distributes the fees to copyright holders such as Hollywood studios and sports leagues and local television stations. Each year, the CRT collects tens of millions of dollars in fees that it distributes to rights holders.
•- For example, if a Los Angeles TV station is carried by a multichannel video programming distributor (MVPD) outside the Southern California area, that MVPD pays a fee to the CRT. If the distant signal portion of the act was gone, the MVPD would go to the individual suppliers of the programing to negotiate an agreement, a much more costly and tedious process.
•- One company watching this closely will be Tribune, the parent of the Los Angeles Times and owner of WGN, a local TV station that is carried nationally by MVPDs and hence would be most affected by any change to the distant signal part of the act.

Creating Hollywood's largest entertainment union was easy this time around. Members of both unions voted overwhelmingly to combine into a single bargaining unit.
Before March 30, 2012, the Screen Actors Guild (SAG) was a stand alone labor union representing over 105,000 film and television principals and background performers worldwide.
••• AFTRA has about 70,000 members who are actors as well as singers, dancers, disc jockeys, sports announcers, comedians and broadcast journalists, among others. About 40,000 people hold membership in both labor groups. The historic vote comes nearly two years after union leaders began discussions to merge in a bid to gain more leverage in contract negotiations with studios and to end a long history of jurisdictional disputes and feuding over negotiating strategy.

114- Donna Summer - 1948-2012
/Imagespeople/114DonnaSummer-2009-46w.jpgLaDonna Adrian Gaines (December 31, 1948 &endash; May 17, 2012), known by the stage name Donna Summer, was an American singer-songwriter who gained prominence during the disco era of the late 1970s. She had a mezzo-soprano vocal range, and was a five-time Grammy Award winner. Summer was the first artist to have three consecutive double albums reach number one on the U.S. Billboard chart, and she also charted four number-one singles in the United States within a 13-month period.
••• Summer died on May 17, 2012. The Associated Press reported she died that morning at her home in Key West, Florida at age 63. She had been diagnosed with cancer. The Bradenton Herald quotes "Sarasota County records" stating that she lived in Englewood, Florida at the time of her death. The reference did not state the place of her death. It was in 1970, that Troy, Ambros Seelos, music arranger, composer and songwriter, Sylvester Levay, (Lysy, Levy - "Fly, Robin, Fly" ) and lyricist and translator, Jossi Sigl produced the origianal recording sessions and the Cory/Seelos concert performances in Germany, Innsbruck, Austria, and Basel, Switzerland. On March 5th, 2012 Robert Sherman, died at the London Clinic of an age-related illness, his family said. He was 86.
• TVI-VRA TelePlay Pictures CEO, Troy Cory said, "--
"the Sherman Brothers were not only Walt Disney's songwriters of choice, but they were mine also.
They had their "golden moments" when everything turned right, as Dick Sherman said during his brother's funeral service.
Their music for "Mary Poppins" included the jaunty "A Spoonful of Sugar" and the somber "Feed the Birds" --They were the men that introduced me into the world of music publishing and as a song writer of my own recordings with Cinema Prize, Bingo, Mercury, and Highland Records.
Along with Bob Roberts, Ralph Freed, Tip Tobin and Dorothy Swafford, we wrote "Rinky Rou RAW," "There's No Fool Like a Young Fool," "Torture," "Tall Paul," "Little Pink Toe," and many others in 1959, and the early 60s. We sometimes used the names Sherwood, Roberts, Sharon & Silbert, and Tip Tobin for ASCAP and BMI purposes.

•••• Victor Harwood who is presiding over several annual trade shows dealing with entertainment, media, advertising and technology events, besides Digital Hollywood, said back in 2007, "The idea of putting together a tradeshow by hassling people to buy booth space is old -- anyone who did that is not in business anymore."
•••• His upcoming Fall confab at the Ritz Carlton Hotel, in Marina Del Rey, CA, made up of separate multi-track but co-located events is still the only conference that brings together creatives, agents, distributors, technologists, financiers, lawyers and media -- legally, it's very hard for a lot of these people to be in the same room, unless there's a common purpose and a common theme.
